Terms of Service

The legal terms that govern access to DeepTech, LMS Education services, course content, proctoring, Cyber Lab usage, and account responsibilities.

Acceptance of Terms

Welcome to LMS Education. By accessing or using our platform, you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and APQOR TECHNOLOGIES PRIVATE LIMITED. Your use of the LMS Education platform, including our website, mobile applications, and associated services, is subject to these Terms.

By creating an account or accessing the Service, you represent that you are at least 18 years of age or have the consent of a parent or legal guardian, and that you have the legal capacity to enter into these Terms.

Use of Service

APQOR TECHNOLOGIES PRIVATE LIMITED grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial educational purposes, subject to these Terms.

You agree not to

  • Share account credentials or allow others to access your account.
  • Use the Service for any unlawful purpose or in violation of applicable laws.
  • Reproduce, distribute, modify, or create derivative works of our content without permission.
  • Attempt to circumvent security features or access restrictions.
  • Use bots, scrapers, or automated systems to access the Service.
  • Interfere with the integrity or performance of the Service.
  • Engage in academic dishonesty or cheating during assessments.

User obligations

  • Academic Integrity: Maintain honesty in all academic activities and assessments.
  • Account Security: Keep login credentials secure and confidential.
  • Acceptable Use: Use the Service in a manner consistent with all applicable laws and regulations.
  • Respectful Conduct: Treat other users, instructors, and staff with respect and professionalism.

Cyber Lab, BYOL, and VM usage

  • Cyber Lab environments are provided only for lawful educational, training, and authorized internal security practice purposes.
  • If you connect third-party software, credentials, endpoints, or licenses through BYOL workflows, you are solely responsible for ensuring they are lawfully obtained and compliant with vendor terms.
  • We provision infrastructure only. We do not provide, validate, endorse, or assume liability for cracked, pirated, shared, expired, or otherwise unauthorized software, licenses, keys, or credentials introduced by a user or institution.
  • We may require in-product acceptance of Cyber Lab disclaimers before you configure BYOL credentials or launch VM-based lab environments.

Prohibited Content and IT Act Compliance

In compliance with the Information Technology Act, 2000, you are prohibited from posting, uploading, or sharing content that is obscene, harmful, illegal, hateful, misleading, malicious, or infringing on intellectual property rights.

We reserve the right to review, monitor, and remove content that violates these Terms or applicable law. We may also suspend or terminate accounts of users who repeatedly post prohibited content.

  • Obscene or offensive content: Pornographic, sexually explicit, or otherwise obscene content.
  • Harmful content: Defamatory, harassing, threatening, or privacy-invasive content.
  • Illegal content: Content that violates applicable laws or regulations of India.
  • Hate speech: Content that promotes hatred, discrimination, or violence against protected groups.
  • Malicious content: Viruses, malware, or code designed to harm or disrupt systems.

Account Registration

To access certain features, you must create an account and provide accurate, current, and complete information. You agree to update that information as needed.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of unauthorized use or any other security breach.

We may suspend or terminate your account if we suspect unauthorized or fraudulent activity, or if you violate these Terms.

User Content

You may submit, upload, or post content to the Service, including comments, discussion posts, project submissions, and portfolio items. You retain rights to your User Content, but grant APQOR TECHNOLOGIES PRIVATE LIMITED a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content in connection with operating and improving the Service.

You represent that you own or have the necessary rights to your User Content and that it does not violate third-party rights, privacy rights, intellectual property rights, or applicable laws.

Intellectual Property

All content, features, and functionality of the Service, including text, graphics, logos, videos, software, and course materials, are owned by APQOR TECHNOLOGIES PRIVATE LIMITED or its licensors and are protected by Indian and international intellectual property laws.

Course materials are provided for personal educational use only. Downloading, redistributing, or commercially exploiting course materials is prohibited unless explicitly permitted in writing.

Course Enrollment and Refunds

When you enroll in a course or subscribe to a plan, you agree to pay all applicable fees described at the time of purchase.

For detailed information about refund eligibility, process, timelines, and exceptions, refer to our Refund and Cancellation Policy.

For subscription services, cancellation takes effect at the end of the current billing period unless otherwise stated in the applicable plan terms.

Proctoring and Academic Integrity

Certain courses may require proctored examinations to verify identity and maintain academic integrity. By enrolling in these courses, you consent to video, audio, screen monitoring, and other security measures during exams.

Attempts to cheat, use unauthorized materials, or have another person take an exam on your behalf may result in disqualification, loss of certification eligibility, and account termination.

Proctoring data is retained for verification purposes and handled according to our Privacy Policy.

Privacy and Data Protection

Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to our collection and use of information as described in the Privacy Policy. We implement industry-standard security measures, but no internet transmission method is completely secure.

Limitation of Liability

To the maximum extent permitted by law, APQOR TECHNOLOGIES PRIVATE LIMITED shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, data, use, goodwill, or other intangible losses.

The Service is provided as is and as available, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Our total liability for claims arising from these Terms or the Service shall not exceed the amount you paid to APQOR TECHNOLOGIES PRIVATE LIMITED in the twelve months preceding the claim.

APQOR TECHNOLOGIES PRIVATE LIMITED is not responsible for third-party software, endpoints, credentials, licenses, or other materials introduced into Cyber Lab environments by a user, instructor, institution, or partner.

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, including for violations of these Terms, fraud, abusive conduct, academic dishonesty, or Cyber Lab misuse.

You may terminate your account by contacting support@lmseducation.in. We will process account deletion requests within 30 days, subject to legal and operational retention requirements.

Terms that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

Governing Law and Jurisdiction

These Terms are governed by the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, the E-Commerce Rules, 2020, and other applicable Indian laws and regulations.

Any disputes, claims, or legal proceedings arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms on the Service and updating the Last Updated date.

Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
